Eligibility and scope

You must be at least 18 years old and able to enter a binding contract to use this site. These Terms govern the website, any forms, messages, and any content we publish.

Our role and what governs bookings

We act as an agent for cruise lines, tour operators, hotels, airlines, insurance providers, and other suppliers, together, “Suppliers.” Your booking is subject to the Supplier’s terms in addition to ours, and Supplier terms control as to Supplier services.

Bookings governed by separate terms. Website Terms govern site use only. All trip inquiries, quotes, reservations, and travel services are governed by our Booking Terms and Conditions and the applicable Supplier terms. If these Terms of Use conflict with the Booking Terms and Conditions, the Booking Terms and Conditions control.

Quotes, prices, and availability

Prices, promotions, amenities, and availability can change at any time until a booking is paid in full and confirmed by the Supplier. If a price is incorrect due to a typographical or system error, we may cancel or adjust the booking and will offer options.

Traveler responsibilities

You are responsible for providing accurate information, including legal names matching government ID, dates of birth, and contact details. You are responsible for meeting entry, passport, visa, vaccination, health, and testing requirements for each destination, including transit points. Review confirmations promptly and report issues within 24 hours.

Payments, cancellations, and changes

Deposits and final payments are due by the deadlines shown in your quote or invoice. Many fares are nonrefundable or carry change fees. Cancellations and changes are subject to Supplier policies. We can assist with change requests, however any fees or fare differences are your responsibility.

Insurance

Travel insurance is strongly recommended. We can provide quotes from third party providers. All insurance benefits are governed by the policy certificate from the insurer.

Site content and intellectual property

All site content, including text, graphics, logos, and images, is owned by Beyond the Castle Travel LLC or our licensors and is protected by law. You may not copy, distribute, modify, reverse engineer, or create derivative works without our prior written permission. You may link to public pages for noncommercial purposes, as long as the link does not imply sponsorship.

Acceptable use

Do not use the site in any unlawful way, to infringe rights, to transmit malware, to scrape or harvest data, to overload or disrupt the site, or to attempt to gain unauthorized access. We may suspend or terminate access at our discretion.

Third party links and tools

Our site may link to third party websites, booking tools, forms, and social platforms. We do not control these services and are not responsible for their content or practices. Your use of third party services is at your own risk and subject to their terms and privacy policies.

User submissions and reviews

If you submit content, for example reviews or testimonials, you grant us a nonexclusive, worldwide license to use, reproduce, and display that content for marketing and operational purposes, in any media, without additional consent or payment. Do not submit content you do not own or that violates rights or laws.

Disclaimers

This site and all content are provided as is and as available. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and noninfringement. Travel involves risks, including illness, injury, property loss, weather disruptions, and acts of government or nature. You assume all such risks.

Limitation of liability

To the fullest extent permitted by law, Beyond the Castle Travel LLC, its owners, and agents are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, even if advised of the possibility. Our total liability for any claim related to your use of the site will not exceed one hundred dollars, or if related to a booking made through us, the agency commission received for that booking.

Indemnification

You agree to defend, indemnify, and hold harmless Beyond the Castle Travel LLC and our owners, employees, and agents from claims, damages, losses, liabilities, costs, and expenses arising from your use of the site, your breach of these Terms, or your violation of laws or third party rights.

Changes to the site or Terms

We may update the site and these Terms at any time. The updated Terms are effective when posted. Your continued use after changes means you accept the updated Terms.

Privacy

Your use of the site is also governed by our Privacy Policy. Please review it to understand how we collect and use information.

Dispute resolution, governing law, venue, and precedence

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of laws rules. You agree to exclusive jurisdiction and venue in the state and federal courts located in Montgomery County, Pennsylvania for any dispute that is not subject to Supplier dispute processes or separate booking agreements.

Contract precedence. If there is a conflict between these Terms of Use and our Booking Terms and Conditions for a reservation, the Booking Terms and Conditions control. Supplier terms control the Supplier’s products and services.

No class actions

To the fullest extent permitted by law, you agree to bring claims only in your individual capacity, not as a plaintiff or class member in any class or representative proceeding.

Termination

We may suspend or terminate your access to the site at any time and for any reason. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitations of liability, indemnification, and dispute resolution.
